1. Acceptance of Terms

By accessing or using xSquad ("the Service") at https://xsquad.cl, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time; continued use after changes constitutes acceptance.

2. Description of Service

xSquad is a project management platform that provides tools for Kanban boards, Scrum sprints, issue tracking, team collaboration, and AI-assisted task automation ("Squad AI"). The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any part of it at any time with reasonable notice.

3. Account Registration

To use xSquad, you must create an account. You agree to:

• Provide accurate and complete registration information
• Keep your password secure and not share it with others
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

You must be at least 16 years old to create an account. Accounts are personal and may not be transferred to another person without our prior written consent.

4. Acceptable Use

You agree not to use xSquad to:

• Violate any applicable laws or regulations
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to other accounts or systems
• Scrape, crawl, or use automated means to access the Service without permission
• Harass, threaten, or harm other users
• Use the Service to send unsolicited communications (spam)
• Infringe upon the intellectual property rights of others

5. Your Content

You retain ownership of the content you create within xSquad (projects, issues, comments, etc.). By using the Service, you grant us a limited license to store, process, and display your content solely to provide the Service to you and your team members. We do not claim ownership of your content and will not use it for any purpose beyond operating the platform.

6. Plans and Payment

xSquad offers a free tier and paid plans ("Pro"). Paid plan details, pricing, and features are described on our pricing page. Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or at our sole discretion. We reserve the right to change pricing with 30 days notice.

7. Intellectual Property

xSquad and its original content, features, and functionality are owned by xSquad and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

8. Third-Party Services

xSquad integrates with third-party services including Google (for authentication) and other infrastructure providers. Your use of these third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

9. Termination

You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate your account without notice if you violate these Terms. Upon termination, your right to use the Service will cease immediately. We may retain your data for up to 30 days after termination before permanent deletion, except where retention is required by law.

10. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

11. Limitation of Liability

To the maximum extent permitted by law, xSquad shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Chile, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Santiago, Chile.
